All too often Terms and Conditions are ambiguously worded and at best, difficult to digest. Max Print and Mailing Ltd is committed to providing the highest levels in customer service; therefore we have undertaken a Plain English Wording Policy.
We trust this transparency is indicative of Max Print and Mailing Ltd’s integrity and levels of customer service all of our customers enjoy.

The contents of this website (including all website design, text, graphics, the selection and arrangement thereof and all software compilations, underlying source code, software and all other material) are copyright Max Print and Mailing Ltd or its content and technology partners except insofar as individually stated on particular material or items.

You may view the site and download any part(s) of it to a personal computer (or other device which is capable of accessing the internet) for personal viewing for private purposes only but you are not permitted without our permission (a) to store it or any part of it other than for the purposes set out in this paragraph; (b) print out copies except for your own viewing for private purposes or for the purposes of your business (other than re-publishing such material for commercial purposes); or (c) reproduce, copy or transmit it (or any part of it) in any other way for any purpose or in any other medium. You are also not entitled to alter the content in any way.

Integrity
In the unlikely event questionable material is provided, Max Print and Mailing Ltd reserves the right to decline any project that we believe is inappropriate, libellous or illegal.
Price Variations: Estimates are provided with as much accuracy as possible. The price stated on any estimate will not increase, unless agreed with you, the client, prior to the project being started. Paper prices fluctuate considerably; therefore all estimates are valid for one month.

Tax
If a project is VAT applicable we will always do our utmost to ensure this is highlighted on any estimate and invoice. If Spice neglects to highlight this charge on an invoice or estimate, Max Print and Mailing Ltd can not be held liable for this taxation.

Proofs
Once proofs have been agreed and signed off by you, our customer, Max Print and Mailing Ltd can not be held liable for any mistakes that were not noticed prior to printing the project.

Delivery and Payment
(a) Cancellation of the project – unless Max Print and Mailing Ltd is notified prior to printing the material, the customer will remain liable for the project costs.
(b) The customer will be responsible for any loss or damage to the printed material, if in carriage not under the control of Max Print and Mailing Ltd.
(c) The customer shall make full payment on or before the due date. Max Print and Mailing Ltd reserves the right to charge interest at the rate of 2% above the bank base rate on all overdue amounts. Additionally, the customer will be liable for all costs incurred in the collection of overdue amounts, on a fully indemnity basis.
Variations in Quantities: When projects are printed and subsequently delivered, we will make every effort to ensure that the exact quantity is provided. Whilst every effort is made, Max Print and Mailing Ltd reserves the right for a margin of plus or minus 5% to 10%.

Claims
Every effort is made to ensure that projects are received on time and undamaged. If a project is received damaged, we request written notification within three days. In cases of non delivery, we require notification within five days. Any circumstances preventing customers from notifying Max Print and Mailing Ltd of either damaged or non delivered material, within these time frames, will be taken into consideration.

Liability
Max Print and Mailing Ltd can not be held liable for any losses, caused by delays in transit.
Illegal Matters: Max Print and Mailing Ltd shall be indemnified by its customer for any legal costs relating to damages, penalties, claims, costs and expenses arising out of libellous matter or infringement of copy write, patent, trademark, design or of any properties or personal rights, or which constitutes the tort of passing off, contained in any material Max Print and Mailing Ltd is asked to produce.

Lien
Max Print and Mailing Ltd shall in respect of all unpaid debts due from the customer have a general lien over goods and property of the customer in its possession. Irrespective of if the goods have been paid for, after expiration of 14 days notice to dispose of such goods and property in such a manor and at a price Max Print and Mailing Ltd deems appropriate, to apply towards such debts.

Insolvency
If the customer ceases to pay its debts or cannot pay its debts or has a winding-up petition issued or has a bankruptcy petition issued, Max Print and Mailing Ltd without prejudice to other remedies shall:
(a) Max Print and Mailing Ltd shall have the right not to proceed with the contract or any other work for the customer and be entitled to charge for work carried out, whether completed or not, and materials purchased for the customer, such charge to be an immediate debt due.
(b) In respect of all unpaid debt due from the customer, have a general lien on all the goods and property in his possession, whether worked on or not, and shall be entitled on the expiration of 14 days notice to dispose of such goods and property in such a manor and at a price Spice deems appropriate to apply towards such debts.
Forced Majeure – Max Print and Mailing Ltd will not be liable if unable to carry out any provision of the contract for any reason beyond Max Print and Mailing Ltd’s control including, Act of God, legislation, war, fire, flood, drought, failure of power supply, strike or any other action taken by employees. During the continuance of such a contingency the customer may, by written notice to Max Print and Mailing Ltd, elect to terminate the work and pay for work done and materials used, but subject thereto shall otherwise accept delivery when available.
